Medical Malpractice in Scottsdale, Arizona

In Scottsdale, the first fork in a malpractice question is who was on the other end of the care. A Scottsdale Fire Department paramedic belongs to a city department. A doctor in a private practice does not. Those two situations can carry very different deadlines, and the city has its own instructions for claims. There is also no Superior Court courthouse in Scottsdale. Here is what the official sources show.

Scottsdale Fire is a city medical service

The Scottsdale Fire Department says every one of its firefighters is trained as either an emergency medical technician or a paramedic, and that each response unit arrives with at least two paramedics. The department works under the guidance of a licensed physician who serves as the City of Scottsdale Medical Director.

The department also runs a ground ambulance program. Its own description says patients are not charged for care on scene; costs apply only when someone is transported, at fees approved by the Arizona Department of Health Services under the department’s Certificate of Necessity.

Why this matters: care from a city crew may be care from a public employee. Arizona sets a 180-day notice of claim and a one-year lawsuit deadline for claims against a public entity or public employee, both counted from accrual. Those are far shorter than the two years that usually apply to private care. Scottsdale’s own claim instructions

The city’s Safety and Risk Management page is brief. It says a person who wants to make a claim against the City of Scottsdale will need to comply with A.R.S. 12-821.01, and that the Safety and Risk Management Division will provide a Notice of Claim form on request to help with filing.

That page does not give a separate address for filing claims. The only address on it is the city’s general one in the page footer, and the page does not say claims go there. So we do not list one. Under the statute, the notice has to reach the person authorized to accept service for the public entity, which is something a lawyer confirms.

The statute itself also sets the content. A notice must explain the facts behind the claim, state a settlement figure, and back that figure with facts. A notice filed more than 180 days after accrual is barred. Writing to us through our form does not pause or stop any deadline.

A table cannot sort out a mixed case, such as a city crew followed by a private emergency department. Each person and each employer may have to be looked at separately. Arizona’s definition of a public employee also excludes independent contractors.

There is no Superior Court courthouse in Scottsdale

The Superior Court in Maricopa County has general jurisdiction over civil cases above the justice-court limit. On the court’s location list, the only Scottsdale entry is an Adult Probation Department office on East Butherus Drive. It is not a courtroom.

The court’s directory tags its Civil department to the East Court Building in downtown Phoenix. The Clerk of the Superior Court takes filings online, by mail or at counters in downtown Phoenix, north Phoenix, Mesa and Surprise. None of those counters is in Scottsdale, and attorneys file civil cases electronically. A directory tag does not tell you where a given case would be heard.

Private care and the two-year rule

When the care came from a private provider, A.R.S. 12-542 sets the usual limit: two years from when the cause of action accrues. Accrual is not always the date of the appointment or the procedure. How that start date gets fixed is the subject of our guide to Arizona malpractice deadlines.

How do I get a notice of claim form from the City of Scottsdale?
